Punishment for stalking, opinion of Iusland Lawyer Irina Uradovskikh

Lawyer Irina Uradovskikh commented to the editors of Business FM on the expediency of the amendment proposed by the State Duma on punishment for persecution, that is, for the systematic commission of actions aimed at causing moral suffering to the victim.

As Irina noted: “We see, in particular on television, that in other states there are measures when one person is prohibited from approaching another person, thus protecting privacy. Many people think that here in Russia this does not exist.

In fact, if we look at what is happening as harassment and how to counteract it, in civil proceedings this can also be done. In this case, administrative liability is not required; it is enough to have convincing evidence that one person is harassing another, thus interfering with personal life. With a good evidence base, the courts make a decision and even, in case of its violation, apply judicial assistance.

That is, if a court decision in a civil case is not enough for a person, and he continues to interfere in his personal life and persecute him, then for each such violation a fine of a certain size is applied. It happens that 50,000 rubles are charged for one event. This has a good effect - some people still stop and stop such actions.”

According to the bill, if a crime is committed for the first time, the citizen will face a fine of 2,000 rubles. For the same actions using the Internet, it is proposed to set a penalty of up to 3,000. For a repeat offender, it is proposed to fine in the amount of 5,000 rubles, or arrest for up to 15 days.
