Managing partner Elena Legashova and advisor Ekaterina Dmitrikova participated in the Scientific-practical conference of Saint-Petersburg University on monitoring law enforcement

April 24th 2019 in Saint-Petersburg University a Scientific-practical conference on monitoring law enforcement took place, which is held by the University since 2011. Managing partner Elena Legashova and advisor of Iusland Law Offices Ekaterina Dmitrikova participated in the event.

Elena Legashova made a report on the topic of “Problems of law enforcement practice in customs regulation”. She pointed out the current state of the law enforcement practice in the area of establishing and controlling the customs cost. Among other issues Elena highlighted that to this day there are no legal administrative rules when it comes to making initial decisions about applying methods of identifying the customs cost and no order of consultations with the customs authorities about the cost.

Ekaterina Dmitrikova in her report on the topic of “Allocation of duties and responsibility between declarants and other subjects operating in the customs field” focused on the problems of applying norms on solidarity duty of a declarant and a customs representative.

Dean of the Law Faculty S.Belov presented the law enforcement monitoring method that was developed in the University, and discussed with the advisor of Russia’s Minister of Justice Y.Zudov the usefulness of receiving information about the reaction of authorities on the problems which appeared during the monitoring.

There was a discussion during the conference on the efficiency and the potential of multidisciplinary approach to monitoring, including not only lawyers in the research, but sociologists, psychologists and other specialists.

Within the law enforcement monitoring actions not only the officially open (published or put out for an open access on websites) law enforcement acts were analyzed, but also the decisions of the public authorities, which are not allowed to be published. For collecting those decisions Saint-Petersburg University, with the help of the Ministry of Justice of Russia, based on the agreement between the Ministry of Justice of Russia and Saint-Petersburg University, cooperates with the public authorities which make adequate decisions.

The collected data is compiled and analyzed by the experts of the University. The qualified analysis of the collected practice helps to surface the causes of collisions found in the law enforcement, and also find the ways of possibly solving them, which are linked to making changes in normative acts and their interpretation.

The problems of law enforcement which surfaced in the process of monitoring are transferred to the ministries’ administrations and authorities, the leaders of subjects, local governments and also officials of other public authorities in the form of a monthly expert report on the result of the monitoring.
