Elena Legashova, Managing Partner of Iusland Law Offices, commented to the business newspaper Delovoy Peterburg in connection with the customs dispute between LLC Margaron and the St. Petersburg Customs

The Arbitration Court of St. Petersburg and the Leningrad Region declared 53 customs notices on unpaid duties illegal and ordered the company to refund overpaid payments, as well as state duty in the amount of 2.65 million rubles.

Elena Legashova highly appreciated the decision of the court of first instance, calling it justified, but drew attention to a systemic problem:

"The approach demonstrated by the customs authorities in this case is widespread and causes a large number of cancellations of customs decisions by the courts. In this dispute, the argument about the existence of a contract with the manufacturer of the goods and the actual intrusion of customs into the issues of how the importer should organize its commercial activities and from whom to purchase the goods is of interest."
